Terms of Service

1. Acceptance of These Terms

These Terms of Service govern your use of the ZarSage AI desktop application, the ZarSage website, and related online services (together, the "Service"). "ZarSage", "we", "us", and "our" refer to ZarSage AI. By creating an account, activating a license, or using the Service, you agree to these terms. If you do not agree, do not use the Service.

2. The Service

ZarSage AI is a desktop precision-agriculture assistant. It combines local, on-device farm records with online features such as AI-generated insights and briefings, weather and soil data, satellite imagery, and map search. Paid subscriptions include AI usage measured in monthly credit allowances, with fair-use daily caps, as described on our pricing page. Feature availability and allowances vary by plan.

3. Accounts and Licenses

You are responsible for your account credentials and for all activity under your account. You must provide accurate information and keep it up to date.

Direct website, Windows, and direct Mac subscriptions are activated in the desktop app with a license key. Each direct license may be activated on up to 2 devices. You can manage and deactivate devices from your account dashboard. A license is for your own operation: it may not be shared, resold, or used to provide the Service to third parties.

The Mac App Store version is a separate Apple purchase channel. Mac App Store subscriptions are purchased and restored through Apple's StoreKit in-app purchase system, are associated with your Apple purchase and ZarSage account session, and do not use ZarSage license keys.

4. Subscriptions, Billing, and Trials

Payments are processed by Polar, our merchant of record. Your purchase is also subject to Polar's terms. Prices are shown at checkout and on our pricing page. This applies to purchases made through the ZarSage website and direct desktop distribution channels, including Windows and direct Mac downloads.

If you subscribe to ZarSage AI through the Mac App Store, payment, renewal, cancellation, refunds, and purchase management are handled by Apple under Apple's applicable terms. The Mac App Store app does not link to Polar checkout, does not ask for a ZarSage license key, and receives updates through the Mac App Store.

Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel at any time from your account dashboard; cancellation takes effect at the end of the current billing period, and you keep access until then. Where a free trial is offered, you can cancel during the trial without charge.

AI credit allowances reset monthly and unused credits do not carry over. We may apply fair-use limits, including daily caps, to keep the Service reliable for everyone.

5. Acceptable Use

  • Do not share, resell, or distribute license keys, or exceed the device activation limit through circumvention.
  • Do not attempt to bypass, probe, or interfere with usage metering, plan limits, or security controls.
  • Do not use the Service to violate any law, infringe the rights of others, or transmit malicious code.
  • Do not access the Service through automated means outside the app's intended interfaces, or place unreasonable load on our infrastructure.

We may suspend or limit access that we reasonably believe violates these terms, while we investigate and where practical with notice to you.

6. AI Output and Agronomic Information

ZarSage AI provides decision support, not professional advice. AI-generated insights, briefings, scouting assessments, and recommendations are informational only. They are not professional agronomic, financial, legal, or regulatory advice, and they are not a substitute for the judgment of a qualified professional where one is required.

AI output can be incomplete, outdated, or wrong. Weather, soil, and satellite data come from third-party sources and models that may be inaccurate or delayed. You remain responsible for your operational decisions, including planting, treatment, input use, and compliance with local regulations on pesticides and other inputs. Verify recommendations against product labels, local guidance, and your own knowledge of your fields before acting.

7. Your Content and Data

You own your farm records and the content you create in the app. You grant us the limited rights needed to operate the Service, such as processing the context you send with an AI request in order to generate a response. Our handling of personal information is described in our Privacy Policy. Most farm records stay on your device; back up your data using the tools in Settings.

8. Intellectual Property

The Service, including the app, website, branding, and underlying software, is owned by ZarSage AI or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the app for your own farming operation during your subscription. You may not copy, modify, reverse engineer, or create derivative works of the Service except where the law permits.

9. Service Availability and Changes

We work to keep the Service reliable, but we do not promise uninterrupted or error-free operation. Online features depend on third-party providers and connectivity. We may add, change, or remove features, and we may discontinue the Service with reasonable notice. The local-first design means your on-device records remain accessible in the app even when online features are unavailable.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and any warranty that AI output, weather, soil, or satellite data will be accurate or complete.

11. Limitation of Liability

To the fullest extent permitted by law, ZarSage AI will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost crops, lost revenue, or loss of data, arising from or related to your use of the Service. To the fullest extent permitted by law, our total liability for all claims related to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access for material breach of these terms, including license sharing or attempts to bypass usage limits. Sections that by their nature should survive termination, including Sections 6, 8, 10, and 11, survive.

13. Changes to These Terms

We may update these terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
